Legal Separation

Legal separation does not officially end a marriage, but it includes all the other elements of a divorce, including property division and agreements on child support and visitation, custody and alimony.

Legal separation is a viable alternative to divorce for people who have recently moved to the area and have not met California's residency requirements for divorce. You must have lived in the state for six months and in a specific county for at least three of those six months to file for divorce. Legal separation has no such requirement.
